These Terms & Conditions (the “Terms”) form a legal agreement between you and Aurenia Group Limited(“Aurenia”, “we”, “us”, or “our”) governing your access to and use of Duck Hunter HQ — our website, applications, and related services (together, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Duck Hunter HQ is a gamified community platform built around the real-world “Cruising Ducks” trend: people hide small rubber ducks aboard cruise ships, and finders scan a code to view the duck’s profile and “sign the log.” The Service lets you create digital duck profiles, generate codes/tags for physical ducks, record finds, collect ducks, earn experience and badges, play a mini-game, and view community leaderboards and maps.
We are an independent platform. We are not affiliated with, sponsored by, or endorsed by any cruise line, vessel operator, or their affiliates. See Section 14.
We do not knowingly collect personal information from children under 13 except as described in our Privacy Policy. If you believe a child has provided us information without the required consent, contact us at hello@aureniagroup.com.
You may begin using the Service anonymously. To unlock the full experience you can claim your account by verifying an email address. You are responsible for the activity that occurs under your account and for keeping access to your email and devices secure. The information you provide (such as your display name, home city, and country) must be accurate and not misleading, and must not impersonate another person.
You agree that you will not:
We use automated and manual moderation. We may flag, hide, reject, or remove content and finds, suspend XP, and suspend or terminate accounts that we reasonably believe violate these Terms.
“Your Content” means anything you submit to the Service — duck names and designs, hider messages and hints, find logs, journal notes, photos you upload, thank-you messages, and similar. You retain ownership of Your Content.
You grant Aurenia a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, adapt, and distribute Your Content for the purpose of operating, promoting, and improving the Service. Some of Your Content (for example, find logs, public duck profiles, leaderboard entries, and photos attached to a find) is visible to other users and the public by design. You are responsible for Your Content and represent that you have the rights to submit it and grant this licence.
The Service has a real-world component. You are solely responsible for any physical duck, tag, or object you create, place, hide, find, keep, or move, and for doing so safely, lawfully, and in accordance with the rules of the ship, venue, or location involved. Do not place objects where they could create a hazard, obstruct crew, or damage property.
Aurenia does not supply physical ducks and is not responsible for any loss, injury, damage, or dispute arising from real-world activity connected to the Service. Participation is voluntary and at your own risk.
The Service offers a free tier and optional paid passes (currently “Voyage” and “Captain”). Each tier has limits on how many ducks you can create within a given window; current limits and prices are shown on the passes page before purchase.
Except where required by applicable law, payments are non-refundable. A paid pass is tied to one account; benefits that extend to a crew are described on the passes page and apply only while the pass is active.
You may stop using the Service at any time and may request deletion of your account as described in the Privacy Policy. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
The Service, including its software, design system, artwork, text, logos, and the “Duck Hunter HQ” name, is owned by Aurenia or its licensors and is protected by intellectual-property laws. Except for the rights expressly granted to you to use the Service, these Terms do not transfer any rights to you.
We rely on third-party providers to operate the Service, including Supabase (database, authentication, and storage), Stripe (payments), Vercel (hosting), PostHog (product analytics), and an email provider for notifications. Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services we do not control.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content or find data is accurate or complete. Connectivity at sea may be limited and is outside our control.
To the maximum extent permitted by law, Aurenia and its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury or property damage arising from real-world activity, however caused. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) CAD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless Aurenia from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, your real-world activity, or your breach of these Terms or of any law or third-party right.
Duck Hunter HQ is an independent fan-and-community platform. Any cruise line, ship, or brand names that appear are the property of their respective owners and are used for identification and descriptive purposes only. Their appearance does not imply any affiliation, sponsorship, or endorsement.
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree that the courts located in Ontario, Canada will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any non-waivable rights you have under the laws of your place of residence.
